Incident Details
- Incident Description: Purchased a J.A.Y. Furniture 11-drawer chest through a kids' furniture retailer, for our 3-year-old son's bedroom. I believe it is item number 1133 based on pictures on the J.A.Y. Furniture website.
J.A.Y. Furniture's website is http://jayfurnitureco.com, and shows a business mailing address of 167 Via Trevizio, Corona, CA 92879.
Brought the chest/dresser home on Friday, 9/25. Today, on Sunday, 9/27, the chest tipped over onto our son. Thankfully, he was not seriously injured. However, we believe the chest tips over way too easily, and is dangerous and defective. I have videos showing that the chest tips over on its own when the bottom three drawers are pulled out, all drawers empty, without a child climbing on it.
This chest/dresser needs to be pulled from the market. A chest/dresser should not tip over simply because a few of its drawers have been pulled out at the same time. This product is dangerous, especially in a child's room.

Comments from the Manufacturer/Private Labeler
- Jay Furniture is committed to the highest standards of quality and safety for consumers. We observe all regulations on the production and manufacture of all our products in that spirit, and work with our retailers to make sure that consumers receive well-made furniture with clear instructions on assembly and safety, including the product reported by the consumer.
We are aware that unsecured chest drawers can be hazardous, especially around young children who may be using products in a way that is unsafe. To make sure that our products are safe for all consumers, we provide warning labels and assembly safety instructions on all our products, including the chest of drawers in question. Stores and consumers are also aware of the manufacturer warning labels, which are clearly printed on the outside of the boxes. With this product, inside the top left chest drawer, a manual was included on how to properly install and use the product. The consumer pulled out 6 drawers at one time causing the chest-drawer to tip over, which goes against the instruction manual provided - the manual clearly states that the drawers should only be pulled out one at a time. In addition, he did not install the anti-tip device that came with the chest drawer. Inside the top drawer, there is hardware used to secure the chest drawer to the floor or wall to reduce risk of tip-over and injury. Again, these actions went against the manufacturer instructions found in the manual.
According to the American Society for Testing and Materials (ASTM) International, 2009 guidelines state that furniture must be shipped with a tip-over warning label, tip-restraints, as well as directions for installing the tip restraints ("ASTM publishes revised"). As evidence of our adherence to these guidelines, please reference the pictures we've sent of the warning label itself, where you can locate the manual in the box, as well as photos of the chest drawer with tip-over attachments.
