  • Incident Description: The caller is reporting all of her household furniture which was purchased in 2005. She didn't have any problems with the cherry wood and marble furniture until about the second week of April 2014 when the marble broke from the wood and fell to the ground. She contacted her retailer, was advised that there was no longer a warranty because it was for one year only. They did however send someone to inspect the furniture and found that marble was cracking in all 13 pieces of this furniture. Inspection: April 19, 2014 SVC#[REDACTED] Safety Issue with cracking marble noted. She is reporting this as a severe safety hazard because the marble is heavy, she has a small child and anywhere the furniture has been purchased there is a [likelihood] that it is cracking and could fall to the ground and injure a small child easily. There are no injuries being reported The caller has not contacted the manufacturer and has no idea how to contact them. To whom it may concern: The consumer’s name is [REDACTED]. Her husband [REDACTED] and she purchased their first home in December of 2004. They looked around to different stores and decided to purchase all of their furniture from Art Van. They went with a great quality wood and real marble because they were promised it would last. Their bedroom set and entertainment center were purchased on January 10th 2005 for the amount of $7428. They were very happy with their purchase and loved the furniture they picked. On April 13th, 2014 the consumer’s husband and she were watching TV in the evening and heard a very loud noise coming from upstairs which is where their master bedroom is located. When they got to the room they saw 5 large pieces of marble on the floor. The pieces were from their big dresser. They started looking at the marble edges of the rest of the furniture and the entire big dresser and night stand had cracked marble. They started looking at the marble on the bed which was also cracked. They went back downstairs to look at their big entertainment center and at the very top, the marble edge was cracked also. The marble can fall at anytime at this point. The consumers have a 3 year old granddaughter that visits all the time and they don’t feel safe with having her or anyone else stand close to the entertainment center. They do not want anyone to get hurt. The consumer’s husband and she no longer feel safe in sleeping in their bedroom as they are afraid that marble pieces from the posts will fall and hurt them in the middle of the night. The consumers went to the Art Van they purchased their furniture from and the Manager told them that the one year warranty had expired and that Art Van was not responsible for the consumers’ safety. The Manager suggested to have someone come out to the consumers’ house and investigate what happened. The cost to have an investigator come over was $60. They covered $30 and the consumers paid $30. The investigator came on April 15th and after an hour he concluded that all the marble pieces of the furniture are cracked and it is a safety issue. He said that he would inform the store manager and they would get back to the consumers. The store manager said that there was nothing they could do since the furniture is more than 1 year old. The consumers are looking for a replacement or a store credit to replace their bedroom set and entertainment center.
